Moral Permissibility of Torture

To most, torture is seen as action with a single definition that defines it, but in fact there are different types of torture that Henry Shue discusses in one of his articles. According to Shue there are rare conditions under which torture could be morally justified, but he does not endorse neither the interrogational torture not the terroristic torture. Although Shue agrees with illegality and morally wrongness of torture, he explains how one may go about defending torture and how it could possibly be morally justified. Henry Shue begins his article discussing torture with constraints which allows the victim to â€Å"surrender† and comply with the demands of the torturer. According to the Constraint of Possible Compliance (CPC), â€Å"the victim of torture must have available an act of compliance which, if performed, will end the torture† (Shue 427). With the aim of interrogational torture being to extract information from a person with holding it, this torture appears to satisfy the constraint of possible compliance, since it offers an escape, in the form of providing the information wanted by the torturers, which affords some protection against further assault. In practice there are evidently only a few pure cases of interrogational torture. For the most dominant type of torture that occurs today is considered to be terroristic. Terroristic torture is meant to put fear in not only the victim, but also all those who oppose that government. The victim’s suffering is being used as a means to end over which the victim has no control over. Terroristic torture cannot satisfy the constraint of possible compliance because its purpose, intimidation of persons other than the victim of the torture, cannot be accomplished and may not even be capable of being influenced by the victim of the torture. If terroristic torture were actually to be justified, the conditions would of course have to be met. The first condition Shue defines is the purpose being sought through the torture would need to be not only morally good, but also supremely important. These purposes would then have to be selected by criteria of moral importance which would themselves need to be justified. The second condition described is that the torture would presumably have to be the least harmful means of accomplishing the supreme goal. With the terrible pain and harm that is associated with terroristic torture, this condition could rarely be the case in this type of torture. The last condition Shue defines is it must be absolutely clear for what purpose the erroristic torture was being used, what would constitute achievement of that purpose, and when the torture would end. Henry Shue believes these three conditions will never be met primarily because terroristic torture tends to become a routine procedure in methods of governing and once it is set in motion by that government it would gain enough momentum to become a standard operating procedure within the government. Shue also describes how governments to choose to try and prove themselves to other nations, over eliminating themselves from the fight.

The Dramatic Impact of The Witches in Macbeth

Witchcraft in the 17th centaury was frowned upon by the church as a result witches were feared and loathed in the community. Many people thought that they were directly connected to Lucifer (the devil). Their evidence of this was that the devils familiars came up from hell and drank the witches blood from devil spots (moles or birthmarks), in return for this blood he would grant them special powers such as the ability to fly, foul crops or kill at a glance. As a result of this propaganda created by the church thousands of innocent people were tried as witches and burnt at the stake. To be in a 17th centaury audience and have witches appear on stage would be terrifying and cause a genial reaction of shock and disgust. Also the king of the time James the first had an interest in witchcraft specifically the torture of witches. He even wrote a book demonology which listed all the horrible means in which to torture a confession out of them. So adding this to the play may have been Shakespeare's way to please the king. Act 1 scene 1 gives a dramatic start to the play arousing our curiosity over the mysterious identities of the three witches and creating a puzzling spectacle. This is because when you enter the scene the witches have almost finished there current meeting and appear to be planning the next one as they say â€Å"when shall we thee meet again†. This creates a feeling of mystery because you do not why there are an the moor or who they are. The witches themselves heighten this confusion with there riddling and perplexing language which seems to flow from one witch to the other as if they were all one being, such as when they say â€Å"When the hurly burleys done : When the battles lost and won : That will be ere the set of sun†. Each witch responds almost instantly as if continuing the sentence like one being. This crates the atmosphere of a spell or a chant. This enables them to see past the present in to the future such as when they say † when the battles lost and won†, this suggests that they already know the outcome they know more than you. The witches also speak of some very unusual things that suggests that they are not normal. One of the oddest things they say is â€Å"Hover through the fog and filthy air† giving you the impression that they can fly. They also chant â€Å"fair is foul and foul is fair†, which would make it appear that they have a warped perception of reality what you would perceive as foul they would perceive as fair meaning that they can bend the rules a little. This draws you in because you want to know what mischief they can create. In the production that I saw I thought that they carried out this very well with fantastic lighting and sound affects. The witches were dressed in simple black robes and rags, but while reciting there lines there was a battle going on behind them with men falling in all directions which provides a feeling of confusion and that they have more power then the men fighting. I thought that this was brilliant because it gave the beginning of the production a real dramatic exciting start to the play. Then very abruptly they vanished this effect in the production was created by freezing and changing the lighting, this was quite effective as all one stage were oblivious to them. The scene then shifted quickly this then provided a sudden shock at the confusion of what had just happened. When you next see the witches in Act 1 Scene 3 you get to see the true nature of the witches and the malice and brutality of there character. One of them says that see has been killing swine and there is a distinct air of pleasure in her voice. This gives a reaction of disgust and horror to any audience. Another of the witches has been denied chestnuts by a sailors wife and so was going to as a form of revenge forever tempest toss her husband so he will be forever kept awake by an eternal storm and never able to return home. In the production I saw them use a rope as a visual aid to represent in my opinion the sea as they tossed the rope the sea tosses as the rope does, or the rope could have signified a union of there powers all coming together in hatred. This whole scene demonstrates there glut for revenge and there incredible power giving them a hold over nature itself. After this a witch cries that Macbeth is coming they then meet with him and tell him that one day he will be king they then tell Banquo him he will be lesser than Macbeth and greater. After confusing us some more they vanish into thin air Macbeth reacts in fear almost, to which Banquo replies â€Å"look how are partners rapt†. The next time you see the witches the plot has advanced considerably by Act 4 Scene 1 Macbeth has committed treason by murdering the king and become as predicted king himself. Macbeth has lost almost all of his allies and goes to the witches in desperation and seeking information. When he arrives the witches are huddled over a cauldron adding strange ingredients to the cauldron as if expecting Macbeth again demonstrating strange powers of deviation. All of these ingredients are very gory and show how vile and loathsome the witches really are, the witches have also it would appear have put a degree of planning in to this meeting. Another thing that demonstrates there planning is the complexity of many of the ingredients such as † finger of birth-strangled babe ditch delivered by a drab† this also shows the lengths to which they will go to cause mischief. Macbeth orders the witches to reveal there secrets to him showing how he has changed since the beginning of the play where he was honourable and meek. In the production that I watched the witches came in after the banquet scene and climbed over the table and took a goblet from the table and used it as a cauldron, this I thought was an effective addition to the play as it displayed them to be so powerful they undermine the very monarchy. When the witches agree to show Macbeth they give him the potion they had already prepared as if they want to show him, they show him in a series of apparitions. The first apparition is an armed head that tells Macbeth to beware the thane of Fife, to this Macbeth reacts without surprise as he already suspected Macduff. The second apparition is a blooded child (who we later learn to be a child born through suasions ) this apparition tells him â€Å"to be bloody, bold and resolute; Laugh to scorn the power of man for none of woman born shall harm Macbeth†. This true to form with the witches is confusing because he has been told to beware Macduff and then that no man woman born can harm Macbeth. The third apparition is a crowned child holding a tree this apparition tells Macbeth to be lion mettled, proud, and take no care who chafes, who frets, or where conspirers are; Macbeth shall never be vanquish'd be until Great Birnam Wood to high Dunsinane Hill shall come against him†. This is a very good example of Shakespeare's visualisation with mind boggling seemingly impossible tasks like the very woods moving. This apparition makes Macbeth even more sure of himself as he does not believe that this could ever happen. But as Macbeth demands to know more the witches give in very quickly, they then show him with some relish the final apparition this is a vision of Banquo and his airs on the throne the first of the Stuarts. Again more confusion as this means that at some point Macbeth is going to be defeated. The witches then dance and say that they must cheer his spirits almost mockingly they then vanish. In the production the apparitions appeared in the air as giant flouting holograms I thought that this was very effective as it provided visual stimulus to the sound. At the end of the production that I saw they added an extra scene where after Macbeths death the witches stand and point at Fleance, as if to say that he will be next in there makings of mischief. This raises the question of how much the witches are to blame for the whole proceedings , I believe that the witches are not completely to blame and are infant just a catalyst as they never actually told Macbeth to kill the king they just gave him a prophecy of what might happen but his ambition was to great and his impenitency to have what was promised, as Banquo said â€Å"The instruments of darkness tell us truths, Win us with honest trifles, to betray's In deepest consequence.

A Vision, A Possibility

I was born into a family of four who never experienced silver spoons on our mouths. My father passed away when I was still 24 years old. His death, aside from leaving us with loneliness and grief, also brought us to an unstable economic situation. However, the financial constraints were not successful in dampening my spirit and blocking me from my dreams. I always believe that there is always a way in everything if I put my heart into it. With the help of my mother and my older sister, I was able to finish Law at Kwang Woon University in Seoul, Korea in 2004. I also took up Arts and Sciences degree, majoring in Liberal Arts at the Kapiolani Community College in Honolulu, Hawaii in 2006. At present, I am enrolled in Bachelor of Business Administration in Accounting at the Shidler College of Business, University of Hawaii, in Manoa, Honolulu, Hawaii. As an assistant to the director of Samnam Corporation in Korea, I learned to take responsibility and initiative. I took charge of assisting the sales department daily operations, the director’s daily schedules, and documents sent to and from other departments. I also exhibited social responsibility as a volunteer at the Korean Care Home in Kiapu, Hawaii. I am also thankful that I have been given opportunities to share my skills in the martial arts by voluntarily teaching taekwondo at the central YMCA. For me, nobility and honor rises from volunteer works, especially if it means helping those who are badly in need. Even though, I have less earthly treasures, I believe that I can still share something to my countrymen and even to the entire community with my skills and talents. I know these are endowed upon me to be able to share it to others. If granted, the scholarship would provide me with the opportunity to achieve the goals I have set for myself. I am driven to achieve a career in business and I believe that a thorough mastery in accounting would be of great help to me. I envision myself to be a chief executive officer (CEO) of a stable, well-respected, and well-established corporation in the near future. I am greatly interested in Korean economy and I see myself as an instrument that can help the society in its struggle towards economic stability. In particular, I would like to discover what industries would prosper both in the United States and my homeland, Korea, and soon venture in economically-beneficial business undertakings. I am also confident that the scholarship would provide me the opportunity, the resources and the information I would need to delve into deeper researches and analyses. These studies would later on be helpful and informative to other students, to the school, to the community and to the society at large. Moreover, with my great virtue of humility, I never forget to look back from where I come from. Thus, I believe that with my hard work and dedication, I would be of great help to your company and institution. This grant would give me the capacity to share more and help others. Since I am also endowed with the virtue of generosity, I believe that this scholarship would cause a positive multiplier to the community. The report focused on the underlying reasons for purchasing a property in Spain, the methods used by the purchaser to gather information and the overall satisfaction with the purchase process. The intention of the report was to link current theories on consumer purchasing behaviour to the purchase of property abroad. The methodology used was deductive research using a survey approach. The questionnaire was analysed by a means of Chi square and variable comparisons. The results were collected using a postal and an email questionnaire. The investigation revealed a clear link between the level of satisfaction of the purchase process and the level of information and advice sought. The report concluded that the majority of respondents from the questionnaire purchased their property abroad as a holiday home and purchased from an estate agent. The gathering of information and the seeking of advice was prevalent among most respondents; this was reflected in satisfaction levels and the overall purchase experience. The majority of consumers were overall, satisfied with their purchase. However, if given the opportunity to repeat the purchase, most stated they would change something about the process they followed. Many stated they would not use a Spanish agent again due to experiencing communication problems. This area gives scope for future research in order to establish why communication weaknesses are present in the supply of Spanish properties to British citizens.

XY Department Of Software Projects The initial budget of XY Department has 2.3 million pounds requested for implementation of new computer systems of XY department of the federal government, but they decided for work around and spent only 1.5 million pounds due to the shortage of funds. Because of the over head of the departments the system testers were not available to identify the problems in software systems. Because of the over head of the departments the system testers were not available to identify the problems in software systems. Also the scope of the project should be defined the amount of work which needs performing, and the total number of resources required to deploy the hardware software installations across 87 sites. And understand who the stake holders are, and what they expect to deliver also who the testers and enlist their support. After defining the scope and objectives must have a review with stakeholders and agree with them through Project Steering Committees, and including Project Manager, Department chief, and Department managers, testers in the committees. The main drawback of the given project scenario is they have not employed a Project Manager, which is Essential for best project management practices. Good Programmes needs to define what the project is been delivered. As this project scope is to change the outdated computer systems and implementing the latest hardware and equally software around 87 sites, they must determine what real things will be delivered and document with enough detail to enable someone else to provide them efficiently. Also, all these definitions of the deliverables must review and accept by the project steering committee. Good Programmes must define what different ways were require for producing all deliver techniques known as all sites information and Breakdown Structures of each site. They need to find the approximate time and puts the effort that is required in every activity like implementation of Hardware Software on each site also involve the complete project team in estimating how long all activities will take. Set milestones which indicate deadline dates during the project. Also include this into the project plan, and key stakeholders should review the project plan and agree. All the other departments of project planning are unprofitable unless there is no communication between internal or external teams. All the team members must know their role responsibility on the project and every team member should know the scope, objective and milestones of the project. Also it is ideal that every member should know all kind of problems hitting the project. Project Manager should share all kind of information of the project with each and every member of the project. For example if any of the resource is lack of the implementation of the Hardware or software then possibly we miss the deadlines. And there should be plan defined to overcome the risks, and identify as soon as possible. When we have more risks in the project, numbering or assigning the priorities of the risks will help. For Example, If an employee successfully implement the new Hard ware and software in one site, but the problem with one specific component of the Hardware which is know should marked as Low risk category, same way we can define medium and critical risks, Hence everyone would know the total risks in the project with their criticality, including the team members and key stake holders. The budget needs to be corporate. The human resources needs developing and upgrade of policies and manually. The customer related management system is used to design and install. There will be over hauling of response of bid system. The annual audit needs to be prepared. The consultant needs to be engaged and been hired. Observations should be made in a range of contexts, for example they should be done during independent play, during everyday routines and also when the child is engaged in play with others. EYFS MAY 2008 â€Å"planning should be flexible enough to adapt to circumstances†. Observing children will also enable practitioners to understand what their current stage of development is. Without the process of observation practitioners will not be able to fully support the children as they will not have a clear idea on what the child’s needs and interests are. Practitioners must ensure that they gain parent’s permission before they carry out any observations on the children because some parents may not want their child to be observed. During observation practitioners need to look, listen and record what they see in the observation, they must not involve themselves in the observation as it may affect what the child is doing. An assessment is when practitioners analyse observations to see what they tell them about a child. Accurate assessments enable practitioners to make judgements which lead to action to support individual children. They help each child to de velop and learn by ensuring that the practitioners provide children with appropriate experiences and opportunities. Practitioners gather the information in their observations to identify aspects of the child’s learning and development. By doing this it will enable them to assess what a child’s needs and requirements are and how well they can be supported. The final part of the cycle is planning, this is when practitioners then use the information that they have gathered to plan for the child. This could include planning experiences and opportunities that the child could benefit from and also ensuring that the environment is suitable and the child has access to appropriate resources. The practitioner will also need to plan what their role will be in supporting children with their learning and development. Practitioners must ensure that they include each area of learning and development through planning, purposeful play and through a mix of adult-led and child initiated activity. Practitioners must ensure that their planning reflects and supports children’s current interests, learning styles and the stage of development of each child. The planning process enables practitioners to contribute and understand the experiences that they have planned for the children. Practitioners can also ensure that parents and children have a voice in the planning process, for example children can share their feelings and activities that they want to take part in. Parents can also share their knowledge of their child and any additional support that they may require. Practitioners must also ensure that they plan and prepare activities which meet the individual needs and requirements of the children. When planning for the children the practitioners need to bear in mind that whatever is planned for the child is age and stage appropriate and suitable for the child to take part in. There are many different sources that an individual can use the help them when planning for the children, for example each child has their own interests and preferences and they may enjoy playing more with some toys that they do with others. A practitio ner can use a child’s interest and make an activity more exciting and challenging for the child. This will also enable the child to learn new things as well as taking part in something that they enjoy doing. Regular observations and assessments support the practitioner when planning for a child because a lot of information can be processed as the practitioner is able to physically see what a child likes/dislikes doing. Observing the children helps the individual indentify a child’s needs, interests and any additional support that they may require to support their learning and development. EYFS MAY 2008 â€Å"planning should include all children, including those with additional needs†. Practitioners must ensure that they make full use of the observations gained in order to support the child and ensure that their needs are fully met. Within the setting the practitioners can work in partnership with parents/carer’s as stated in the EYFS in order to ensure that they are also included with their child’s learning and development. Parents/carer’s will be able to share information with the practitioners about what the child is like at home and what interest and needs that they may have. Parents/carer’s can help the practitioners with planning for the children as they will be able to identify what area a child may need support with. Sharing ideas with colleagues can be useful during planning as an individual may have noticed something about the child which was not noticed by anyone else, this can be useful as a child may be more close to one member of staff than they may be with another staff. There may be times when a practitioner is not always with the children so it is important that information is shared to ensure that all members of staff are aware on the child’s needs and interests. Within the setting some children may also be under the care of other professionals this is useful because the practitioners are then able to work alongside the professionals to share and also learn new ideas on how the child can fully be supported within each setting. The practitioners must ensure that at all times their planning reflects the different needs and interests of the children, the planning must also provide opportunities for the children where they are able to learn and gain new skills. Differentiate between formative and summative assessment methods. EYFS MAY 2008 â€Å"make informed decision about the childs progress and plan next steps to meet their development and learning needs†. When working with children practitioners will find that settings will carry out progress reviews on children’s development, these can be done every six months or on an annually basis. The practitioners will be required to provide parents with a progress report about the child’s learning and development. This will give the parents an idea on what stage their child is at with their learning and development and whether or not they may require any additional support. Practitioners must ensure that they meet the individual needs of all children through following the requirements of the EYFS and it is important to deliver personalised learning, development and care to help children get the best possible start in life. There are two formal assessments, these are a completion of the progress report at age two and also completing the lear ning and progress journey of each child during their time at the nursery. To ensure that practitioners assess the children effectively they must analyse and review the information that they have about each child’s learning and development. They then need to plan next steps to meet the individual needs of children. A formative assessment is when a practitioner keeps a record of the child’s learning and development. The practitioner will take daily observations of a child using notes and photo evidence and keep them in an individual record of the child. The record will be available for the parents to view, this will enable them to review their child’s learning and development within the setting. It will also give the parents a chance to see what their child has achieved and what stage of development they are at. Practitioners must ensure that they regularly update children’s records by including the appropriate information. Formative assessment: This is an assessment based on observations, photos, work from children or any information that a practitioner receives from the parents. It is also an ongoing assessment of children and is carried out on a regular basis through observations that practitioners gather from children. Children are also required to have a progress check done when they are aged two, this is a summary of information that has been gained about the child. Practitioners compare children to the learning areas to identify whether or not a child has achieved their learning goal for their age and stage of development. The progress checks will be given to parents as it will be a summary of the development stages a child has achieved. They will also consist of targets/goals a child will have for the future and how they will be achieved. Summative assessment: This assessment is a summary of any evidence that a practitioner gains through carrying out a formative assessment. This type of assessments are used to review childrenà ¢â‚¬â„¢s developmental progress over a period of time, they are also used to identify if a child has achieved their target/goals for their age and stage of development. This is a summary of all the formative assessments done over a longer period and makes a statement about a child’s achievements. The EYFS Profile is the summative assessment used to review children’s progress along the early learning goals. Explain the two statutory assessments that must be carried out on all children. EYFS MAY 2008 â€Å"all effective assessment involves analysing and reviewing what you know about each child’s development and learning†. When working with children practitioners need to carry out two main assessments of the children in their care, one is the EYFS progress check which is done at age two. The second assessment is the EYFS profile which summarises and describes a child’s achievements and is a record of their development. This profile is a record of the child up to the age of five up until the child leaves the nursery. These two statutory assessments check the children’s development against the seven areas of learning. The EYFS progress check requires the practitioners to make a summary of the child’s development, achievements and also state any targets or goals that need to be met in order for the child to make further progress with their development. The progress checks show the parents and practitioners any additional support that a child may require. The practitioners are required to review the children’s progress and also ensure that parents receive a written record, this will enable them to see what the child has achieved and what stage they are at with their learning and development. The key workers have the role to complete the progress checks for all of their key children. In some settings the practitioners set up parents evening where they discuss the child’s progress and also hand out the progress checks to the parents. This also gives the parents a chance to discuss their child’s learning and development and also share information or ask and questions. Dr. Faustus and the Christian Moral In the play Doctor Faustus the main character sells his soul to the devil and later dies and is sent to hell. A question that comes to mind when reading this book is, "Does Doctor Faustus have a Christian moral?" Even though he is persuaded to sell his soul to the devil he still may have some Christian beliefs. Some of the dialogue in the play gives some signals that tell the reader if Faustus has a Christian moral. The Cultural Studies method is shown in this paper because we are talking about someone's beliefs or morals. In this play, Marlowe shows Dr. Faustus's religious beliefs. In Act I, Faustus is given the chance to ask Mephostophilis whatever he wants to know. Faustus asks where hell is and he wants some information about hell. When the play starts Faustus is not scared of death and he later tells Mephostophilis "I think hell's a fable" (Marlowe 43). You can also make the assumption that he believes that the only place you go after you die is to heaven. Towards the end of the play he believes that heaven and hell exists and that you can spend eternity there. Faustus could be also thought of as an Atheist because during some of the acts of the play he denies that there is a God and he thinks of religion as a false ritual. Faustus even calls on God, "Ah my God... I would weep, but the devil drains my tears"(96). The part of the play that best describes his beliefs is right after he sells his soul to the devil and he deciding whether or not to repent. He states," My heart is hardened, I cannot repent. Scarce can I name salvation, faith, or heaven. Swords, p oison, halters, and envenomed my steel Are laid before me to dispatch myself.......I am resolved, Faustus shall not repent"(45). When he does finally ask for forgiveness and wants to repent to God, he is denied and is forced to spend eternity in hell. The Cultural Studies method describes someone's moral or beliefs. It can relate to other methods, but they are not as well described in this play. In the play we learn about what Faustus' religious beliefs are and how it relates to Cultural Studies. The book was written during Shakespeare's time and what they knew about Heaven or Hell is probably different than what we believe today.

Thus, the Supreme Court reconciles the issue of that specific case, which is then obtained and written by the Chief Justice of the Court as the final conclusion. Cases that are controversial result in great effect in the Supreme Court. For instance, Brown vs. Board of Education of Topeka in 1954 was one of the most controversial cases that the Supreme Court had to resolve; it violated the Equal Protection clause of the fourteenth Amendment. The case that violated an individual right was the case of Gideon vs. Wainwright in 1963, which violated the Sixth Amendment in a criminal case for the defendant. The case of Miranda vs. Arizona in 1966 is another controversial case that the Supreme Court had to base its judgment in order to have the individuals rights read to them due to the violation of the Fifth Amendment. Cases that are controversial have set many concerns throughout the judicial process of the Supreme Court; therefore, the progress of the people in the Judicial Branch was recognized to appreciate how far the Court has advanced and how superior in power the ... ...s considered to be encroachments to the Amendment and the Constitution. First of all, the TXJ Companies did not have as much security controls at all. The security controls that were in place were controls that were easy for hackers to have access to. The security’s controls weaknesses are that the computers that were used where computers that did not have the correct firewall installed. The firewall that was installed were firewalls that did not have as much of protection. They were not installed properly. The computers did not have any data encryption at all. These computers were easily to be access by hackers. The tools and technologies that could have been used to fix the weaknesses were to upgrade their computers to the latest security system. The computers could had firewalls installed, in order for hackers to stay away. An anti-virus could had been installed in order for malicious data to have access to the computers. The computers firewall should had been installed correctly as well. The business effect of TJX’s data loss to TJX, consumers, and banks were that due to its data loss, this lead to a raised in costs. The costs were from the personal data that had been lost. The business’s costs had raised a tremendous amount. The moral dimensions that may had been applied in this situation where to realize and focus what could had really happened if there were more security from the business. For instance, the business had to think before, after making any actions. The business made the action of not making secured computers and this is why, the business had to deal with a situation like this. The smart choice was not being conducted. By not making the correct decisions, the business had lost a lot.
